1. Acceptance of Terms

By using Evil Apples 4D ("the Service"), including the website at evilapples4d.com, the Evil Apples 4D Discord bot, and any related services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Eligibility

• You must be at least 13 years of age to use Evil Apples 4D.
• You must be at least 18 years of age to participate in paid tournaments, purchase premium features, or engage in any monetary transactions on the platform.
• By entering a paid tournament, you represent that you are of legal age to participate in such transactions in your jurisdiction.

3. Account and Access

You access Evil Apples 4D through your Discord account. You are responsible for maintaining the security of your Discord account and for all activities that occur through it on our platform. We are not responsible for unauthorized access to your account resulting from your failure to secure your Discord credentials.

4. Prohibited Conduct

When using Evil Apples 4D, you agree not to:

• Use bots, scripts, or automation tools to gain an unfair advantage in games or tournaments
• Manipulate game outcomes through collusion, match-fixing, or exploiting bugs
• Harass, threaten, or abuse other players through the platform
• Submit content that is illegal, promotes violence, or constitutes hate speech (the game is meant to be edgy and funny, not harmful)
• Attempt to reverse-engineer, decompile, or disrupt the Service
• Create multiple accounts to circumvent bans or manipulate leaderboards
• Use the platform for money laundering or other financial crimes

We reserve the right to suspend or ban users who violate these rules, with or without notice.

Tournaments may accept sponsorships from third parties. Sponsors agree to provide valid brand information and logo URLs. Evil Apples 4D is not responsible for the accuracy of sponsor-provided content. Sponsorship payments are subject to the same platform fee structure as entry fees.

7. Premium Services

Premium ("Pro") subscriptions unlock features such as ad-free gameplay, custom deck creation, and priority support. Premium status is tied to a Discord server and activated by the purchaser. Premium benefits are described on the Premium page and may change over time.

8. User-Generated Content

When you create custom card decks, submit answers in wildcard mode, or upload content to the platform, you retain ownership of that content. However, you grant Evil Apples 4D a non-exclusive, royalty-free license to use, display, and distribute that content within the Service. You represent that your content does not infringe on any third party's intellectual property rights.

9. AI-Generated Content

Evil Apples 4D uses Venice.ai to generate card prompts, answer cards, and AI judge commentary. AI-generated content is provided for entertainment purposes and may be offensive, absurd, or inappropriate by design. We do not guarantee the accuracy, appropriateness, or originality of AI-generated content. Players engage with AI content at their own discretion.

10. Intellectual Property

Evil Apples 4D, including its name, logo, website design, bot functionality, and original content, is the intellectual property of Evil Apples 4D. You may not copy, modify, distribute, or create derivative works from our intellectual property without written permission. "Cards Against Humanity" is a trademark of Cards Against Humanity LLC; Evil Apples 4D is an independent project and is not affiliated with or endorsed by Cards Against Humanity LLC.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or free of harmful components. We are not responsible for any losses resulting from the use of or inability to use the Service.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Evil Apples 4D and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim arising from the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless Evil Apples 4D, its operators, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third party's rights.

14. Modifications

We may update these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the Service after changes constitutes acceptance of the revised Terms. For material changes that affect your rights or obligations, we will make reasonable efforts to notify users through the Discord bot or website.

15. Termination

We may suspend or terminate your access to the Service at any time, for any reason, including violation of these Terms. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including liability limitations and indemnification) will remain in effect.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation first, and if necessary, through binding arbitration.
